3. Our Services
Max-Tech I.T Solutions provides comprehensive IT services including:
Device repair and maintenance services
Device Care Subscriptions (Bronze, Silver, Gold) for preventive maintenance and support on eligible laptops, mobile phones, and printers
IT support and consultation
Web development and digital solutions
Network setup and security services
Cloud computing solutions
Technical training and support
3.1 Device Care Subscriptions
Device Care is a prepaid subscription for a fixed term (3 months, 6 months, or yearly) and a chosen tier. Pricing depends on whether you enroll as a Personal or Small Business customer and how many devices you cover; details are shown at checkout and on our Device Care pages.
Covered device categories are laptop, mobile phone, and printer counts you provide at signup, subject to the included-device limits and add-on pricing published for your tier.
While your subscription is active and payments are current, we waive any separate diagnostics fee for evaluating covered devices when you request support for issues within the scope of your plan. You may still be quoted for parts, labor beyond the plan, expedited options, or services outside Device Care.
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
4. Device Repair Services
4.1 Service Agreement
Repairs may require diagnostic evaluation. Where a standard diagnostics fee applies to walk-in or non-subscription repair, it is not charged separately for covered devices under an active Device Care subscription when the issue is within your plan scope (see section 3.1).
Repair estimates are valid for 30 days from the date provided
We reserve the right to refuse service on any device
Completion times are estimates and may vary based on parts availability
4.2 Data and Privacy
You are responsible for backing up your data before service
We are not responsible for data loss during repair processes
We may need to access your device to perform diagnostics and repairs
We respect your privacy and will not access personal files unnecessarily
5. Payment Terms
Device Care Subscriptions are billed in advance for the selected term (3 months, 6 months, or yearly) at the price shown when you subscribe, including any applicable add-on device charges.
Payment is due upon completion of services unless otherwise agreed
We accept bank transfers, cards, and other approved payment methods
Prices are subject to change without notice
Additional charges may apply for expedited services
Unpaid devices may be held until payment is received
Storage fees may apply for devices not collected within 30 days
6. Warranty and Guarantees
6.1 Service Warranty
We provide a 30-day warranty on repair services
Warranty covers defects in workmanship and installed parts
Warranty does not cover damage from misuse, accidents, or normal wear
Warranty is void if device is repaired by another party
6.2 Limitations
Warranties are limited to repair or replacement of defective parts
We are not liable for consequential or incidental damages
Maximum liability is limited to the cost of the original service
7. User Responsibilities
As a user of our services, you agree to:
Provide accurate, current, and complete information when using our services
Maintain the security of your account credentials and passwords
Notify us immediately of any unauthorized use of your account
Use our services only for lawful purposes and in accordance with these Terms
Not interfere with or disrupt our services or servers
Not attempt to gain unauthorized access to our systems or networks
Not transmit any viruses, malware, or harmful code
Respect intellectual property rights of Max-Tech I.T Solutions and third parties
Comply with all applicable local, state, national, and international laws
Violation of these responsibilities may result in immediate termination of your access to our services and may subject you to legal action.
8. Intellectual Property Rights
8.1 Our Intellectual Property
All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, icons, images, software, and code, are owned by Max-Tech I.T Solutions or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our services
You may not reverse engineer or attempt to extract source code from our services
You may not use our trademarks, logos, or brand names without our written permission
Any unauthorized use may result in legal action
8.2 User Content
You retain ownership of any content you submit, post, or display on or through our services. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing and improving our services.
You represent and warrant that you have all necessary rights to grant us this license and that your content does not infringe any third-party rights.
9. Limitation of Liability
To the maximum extent permitted by law:
Our services are provided "as is" and "as available" without warranties of any kind
We do not guarantee that our services will be uninterrupted, secure, or error-free
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability for any claims arising from our services shall not exceed the amount you paid us in the 12 months preceding the claim
We are not responsible for any loss of data, profits, or business opportunities
We are not liable for any damages resulting from your use or inability to use our services
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Max-Tech I.T Solutions, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use or misuse of our services
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations
Any content you submit, post, or transmit through our services
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in defending such claims.
11. Termination
11.1 Termination by You
You may stop using our services at any time. If you have an account, you may request account deletion by contacting us.
11.2 Termination by Us
We may suspend or terminate your access to our services immediately, without prior notice, if:
You violate these Terms or any applicable laws
You engage in fraudulent, abusive, or illegal activity
We are required to do so by law or government authority
You fail to pay any fees owed to us
We discontinue or modify our services
11.3 Effect of Termination
Upon termination, your right to use our services will immediately cease. We may delete your account and any data associated with it. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Dispute Resolution
12.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@mtechitng.net. We will try to resolve the dispute within 60 days of receiving your notice.
12.2 Binding Arbitration
If we cannot resolve the dispute informally, you agree to resolve any disputes through binding arbitration in accordance with the Arbitration and Conciliation Act of Nigeria, rather than in court.
12.3 Exceptions
You may bring claims in small claims court or for injunctive relief in court without first going through arbitration.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts in Lagos State, Nigeria, except where arbitration is required as specified in the Dispute Resolution section.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. We will notify you of material changes by:
Posting the new Terms on this page
Updating the "Last Updated" date
Sending an email notification (if you have provided an email address)
Displaying a prominent notice on our website
By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using our services.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and Max-Tech I.T Solutions concerning our services and supersede all prior agreements and understandings.
